At a guess yes it would be a

At a guess yes it would be a fail, as it is part of the suspention set up. If fitted incorectly I'd say it would be a fail. There is also strong anidotal evidence that removing the thing entirely would also be a fail. That said the MOT is a very subjective test. If it were mine I'd take it for a test a week befor it was actualy due without the bar atached. If it fails, you've got a week to get it on properly.
PS. please don't type in upper case only. It is very hard to read when you are dyslexic.

Suspension Mods

Any suspension component fitted to a vehicle at the time it was "Type Approved" must be fitted to the vehicle at all times when it is used on public roads. This in particular, applies to suspension components, as many people are recently removing other items such as panhard rods as well as anti roll bars.

Type Approval is a test which manufacturers of imported vehicles are legally obliged conform to to ensure their vehicles meet the legal criteria applied in law. This happens before a new model is officially imported, and ensures the correct specifications are met, then a certificate of conformity is issued for that vehicle.

All is not lost, it is legally possible to replace the anti roll bar with a different type from aftermarket suppliers. These must be "E" marked for European use, and can be harder, softer, or to original specifications as direct replacement parts.

Due to the increased number of accidents involving modified 4X4's with modified suspensions, VOSA have issued all MOT testing stations with notices. Notices issued address the issues of removed components, and all testers will legally have to fail vehicles with removed suspension items. Testers will also have to refuse a road test as they will be driving "known defective vehicles", and their insurance will be invalid.
